Witnesses that the HOST leased to the GUEST the premises located at:

This lease shall begin on {Checkin_Date} at 4pm for {Number_Of_Nights} nights and end on {Checkout_Date} at 11:00 am and for such term the GUEST agrees to pay the total amount as described in the booking platform.
THE PARTIES HERETO, IN CONSIDERATION OF THESE PRESENTS, AGREE THAT:
1. MAXIMUM OCCUPANCY: Disclosed occupancy of adults, children & animals on the booking determines the maximum occupancy at all times and applies to day visitors and children as well. Unless otherwise approved by HOST, occupancy over the indicated capacity may result in eviction and forfeiture of amounts paid.
2. NO SMOKING or Vaping or illegal drugs of any kind will take place in or on the premises. Vaping outside with windows and doors closed is accepted. A cigarette / vape smoke monitor is on the premises to alert HOST to such vapors and will result in immediate termination of occupancy if detected or a [$250 ]charge. GUEST is liable for the full cost to remove any odor from the home in the case that it exceeds the above charge.
3. NO ANIMALS of any description will be kept in or on premises without prior approval by HOST. * Indication of pet on the platform booking or in the attached questionnaire is required with this contract for approval of pets, emotional support and service animals.
4. DAMAGE & INSURANCE- Your booking comes with an automatic damage waiver policy for up to $1500 for accidental damage. This does not cover intentional damage, negligence, theft, damage to exterior grounds or stained linens or towels (other exclusions apply). A security deposit of $150 may be held for any uncovered damages or fees for breaking house rules. DIRECT BOOKINGS: A security deposit of $600 will be held but not charged to your credit card. Any security deposit held will be returned minus cost of damages or expenses within 7 days of departure.
To avoid personal liability for damages GUEST will ensure that there will be no:
A) damage to property, it’s contents or furnishings,
B) dirt, trash or other mess requiring excessive cleaning, or
C) There is no negligent damage due to inclement weather. It is GUEST’S responsibility to secure items on premises in the case of wind, inclement weather or outside conditions. (i.e. outdoor umbrellas, grill, hot tub and fire pit covers.
D) any other costs incurred by your Host as a result of your stay. Any damage to the Vacation Rental or its contents must be reported before check-out.
E) GUEST is not evicted by the owner (or representative of the owner) or the local law enforcement.
F) No linens or towels are lost, stained, or damaged.
G) The unit is left locked and secured when unoccupied.
H) WATER FEATURE: Children and pets will be kept off of the water feature and out of the flower beds in the backyard. The stream is a fragile system and can be easily damaged or thrown off balance. It is not a play structure. Violation of this policy will result in a $150 fine. If camera footage shows a violation GUEST will be responsible to cover the full cost of having the water feature inspected & repaired if necessary.
To ensure that the proper party is held responsible GUEST must inform management within 24 hours of arrival of any pre-existing damage or issues or may be held responsible for any cost involved in repair to be taken from the security deposit.
Damage not covered by, or exceeding the coverage limit of, the accidental rental damage insurance, Security Deposit, or booking platform coverage, is your full responsibility including any insurance deductibles. You grant your HOST the right to be reimbursed via the booking platform for any such damages, including, but not limited to, additional cleaning fees. If the booking platform refuses reimbursement, HOST has the legal right to pursue reimbursement by reasonable means including small claims court or police report.
5. CLEANLINESS– GUEST agrees to treat the Vacation Rental with respect, keeping in mind that this is an individual’s home and you are a houseguest.
Even if a cleaning fee was charged, you are expected to leave the premises in a clean, neat and orderly condition to allow our cleaners to provide a thorough clean in the very short window between guests.
Management must be notified within 24 hours of arrival if unhappy with conditions upon arrival.
6. NOISE & QUIET HOURS: Quiet hours are between 10 pm and 8 am. At all times GUEST must keep noise levels to a minimum as to not disturb the peace and quiet of surrounding neighbors. Noise exceeding local ordinances or causing a neighbor complaint will be grounds for immediate eviction without possibility of a refund.
7. PARKING – Maximum number of cars GUEST’s party may bring is 5. Parking is designated to the driveway only. No parking on the street. RV parking is permitted In the driveway.
8. CHECK IN / OUT AND LOCK OUT –
Check in and out times are as stated on this contract. Cleaners may be scheduled to show up at check out time to allow time to prepare the home for the next guests checking in the same day. To ensure efficiency, there will be a maximum of 15 minutes grace period beyond check out. If GUEST remains beyond 15 minutes after check out, we will incur a [$35 ] fee per 15 minutes until the home is vacated which will be passed on to the guest.
If an early check in or late check out are desired, arrangements must be made at least 24 hours in advance. Early check in or late check out cannot be guaranteed.
ACCESS: This home is equipped with a keyless entry and your code is active only for the duration of your booking. In the case that the GUESTS lock themselves out of the house and a key is provided, if keys are lost or not returned, the charge is [$100] for a locksmith to rekey the locks.
We recommend that you always use the keyless entry, and if backup access is provided immediately put the key back in the lockbox to avoid losing the key.
9. LINENS & SUPPLIES: For details on what is supplied, please refer to the listing at the time of booking. Please do not refer to reviews for this information, as it may not be current or accurate.
a. The GUEST is responsible to inform all individuals in their party to use only Scott or septic safe tissue, and no other items will be flushed in the toilet even if it says "flushable". Any damage caused by GUEST to the septic or sewer system will be the full responsibility of the GUEST. These terms are subject to change at the HOST’S discretion.
b. Replacement of any damaged or stained linens, pillows or furniture will be the responsibility of the GUEST.
c. GUEST will only bring personal items, no furniture, decor or small appliances are to be brought in to the house without written permission from the HOST.
10. REPORTING OF TRAVEL ISSUES: GUEST agrees to report any issues of dissatisfaction to HOST immediately but no later than 24 hours after discovery. GUEST will cooperate with HOST and allow HOST’s team members to come to the property to verify the issue and remedy before making any reports to the booking platform of dissatisfaction. If GUEST declines this, any possibility of a refund will be forfeited. The home has bi-weekly external pest treatments, and due to the rural nature, it is normal to find some bugs inside the house.
NOTE: Photos are taken of the premises after each cleaning and prior to GUEST check in. These date and time stamped images will be used against claims brought by GUEST.
Any claims made by GUEST that are fraudulent or outrageous in nature or meant to mislead or defraud the HOST, credit card company or payment processor in exchange for a refund or threat of a bad review will be immediate grounds for removal from the premises with no refund and GUEST’S account being reported to the booking platform for removal and is liable for all financial or other damages to HOST.
If the GUEST's communication or behavior becomes unreasonable, disruptive or harassing toward the HOST, they will be asked to immediately vacate the premises without the possibility of a refund and GUEST agrees to comply.
11. REHOUSING – HOST shall not bear financial liability to rehouse or refund GUEST for any amount if unsatisfied or if GUEST chooses to vacate early. GUEST will seek assistance from the booking platform or their travel insurance.
12. CANCELLATION: GUEST can cancel at any time regardless of the Airbnb or VRBO cancellation policy. If the GUEST cancels outside of a free booking period on the booking platform the rent & host fees paid minus a [$75 ] administrative fee may be refunded ONLY if the same or partial dates are re-rented. If re-rented for lesser amount, the difference will not be refunded.
DIRECT BOOKINGS - Free cancellation within 24 hours of booking. 97% refund until 60 days prior to check in. 50% refund until 30 days. Non refundable after 30 days. If the dates are rebooked, the amount paid minus 3%+ a [$75 ] administrative fee may be refunded ONLY if the same or partial dates are re-rented. If re-rented for lesser amount, the difference will not be refunded.
MONTHLY RESERVATION CANCELLATION: Monthly renters must cancel (120) days prior to check-in. Monthly renters who make a change that results in a shortened stay must be made at least (90) days prior to check in.
We highly recommend you purchase travel insurance to cover any losses. Choose your coverage carefully to ensure you are fully covered.
13. GUEST may not lease or sub-lease, nor permit any other persons to occupy premises outside of the disclosed number of occupants, except with prior approval of the HOST.
14. SECURITY CAMERAS / TECHNOLOGY- Exterior cameras, video doorbells, keypads, smart home technology, etc. are installed for the safety and protection of the property and it’s guests and may not be tampered with or disabled, which includes unplugging WiFi. GUEST will be immediately evicted with no return of funds paid upon violation of this policy. We respect our GUEST'S privacy and review footage only upon a report or cause. Backyard camera is occasionally scanned for evidence of breach of the fence by deer.
Security cameras are located in these locations on the exterior and record audio and video for a short duration upon motion activation.

Ring camera - Back of the house facing straight out to the general back yard. (This camera is for the purposes of monitoring wildlife breaching the fences and the view of the fire pit area and hot tub is mostly blocked by the gazebo & umbrella for GUEST privacy) Backyard camera footage is only viewed upon reporting of an issue or to occasionally scan for deer in the backyard.

There are noise monitors that do not record, but send an alert to management in the case that decibel levels exceed those allowed by local municipalities. This monitor also alerts in the case of the presence of cigarette, vape, marijuana or any other type of tobacco smoke, or excessive dangerous smoke often generated by cooking. There is one inside the house and one outside.
15. GUEST must keep property locked & secure when not there. Entry codes are not to be shared outside of GUEST’S party. Garage door must not be opened due to the dust and rocks on the driveway and the potential for damage and dirt to the contents of the game room.
16. GUEST agrees to allow the HOST or his/her AGENT to enter and view said premises with proper notification and a light cleaning (no laundry) is required biweekly during extended vacation stays over 2 weeks (14 days).
17. INTERNET USAGE and LIABILITIES
An illegal or abusive Internet usage is not allowed. In particular, it is not allowed:
a. To send information and data of a commercial nature and/or for marketing purposes to third parties without requested to do so (spamming)
b. to use peer-to-peer networks if uploading or downloading of copyright-protected intellectual property with or without the knowledge of the owner is intended
c. to spread and distribute illegal or immoral content and data; and/or to use applications which could destroy or change the physical or logical structure of the Host equipment or network.
In case of non-compliance with the above obligations, or in case of any other illegal action, the GUEST shall be liable for damages.
d. The HOST does not guarantee wifi speed or that their wifi will be compatible with all of GUEST’S devices or software (including but not inclusive of VPN networks), is not responsible for any damages renters sustain while using Internet access with their own Internet devices and will not offer any refunds as a result.
e. HOST is not responsible for any internet outages that are outside of the control of the HOST and will not offer any refunds for such. The renters must have their own spyware/virus protection or data security, etc.
f. WiFi hardware, connected devices, or any other devices throughout the home must not be unplugged, altered, or tampered with in any way. Management receives notification of such disconnection and if there is evidence of tampering, there will be a $50 re-connection fee payable by the guest which covers up to 1 hr of troubleshooting. GUEST is responsible for the cost of any additional, unforeseen damages to any devices as a result of such disconnection.
18. FALSIFIED RESERVATIONS: If your booking was made under false pretense, including, but not limited to, a falsified name, age, 3rdparty or number of occupants, or undisclosed animals (including service or emotional support animals) you will be subject to immediate eviction and forfeiture of all amounts paid. Exterior cameras may be used upon the HOST’s discretion to verify the size of your group or misuse of the premises.
19. WRITTEN EXCEPTIONS: any exceptions to this entire agreement must be approved in writing.
20. INCLEMENT WEATHER, UNINHABITABLE or ACT OF GOD POLICY:
Should the premises be destroyed by fire or other casualty, extreme weather, utility outage, pandemic or any act of God to become unfit for human habitation or to prevent travel to the property then these presents shall thereby be ended with NO refund to the GUEST for any rent term unused. We highly recommend you purchase travel insurance to cover any losses that include Acts of God.
21. INTENT OF THIS LEASE: The rental of these premises is for vacation or recreational purposes only and the GUEST understands this unit is not available for long term, primary or permanent residency. The GUEST certifies that they reside at the address provided on this agreement as their primary place of residence. Even in the case of a reservation of 30 days or more, this lease falls under lodging law, and the GUEST maintains a primary residency at the address provided and is not protected by CA state residency or tenant law.
22. EVENTS POLICY: The premises may not be used for parties, receptions, weddings, or any type of function which would exceed noise ordinance in or outside of quiet hours, cause abnormal wear and tear or mess or exceed the maximum number of occupants specified in this lease without written permission. **Evidence of these activities will result in a minimum [$1000 ] fine, immediate eviction and/or loss of security deposit.
23. SIGHT UNSEEN - The HOST has endeavored to depict the property and its amenities as accurately as possible in online advertisements. The GUEST acknowledges that they are renting the property without physically inspecting it beforehand and assume any associated risks. Given the communal nature of vacation rentals and the possibility of other guests occupying the premises, despite diligent upkeep efforts, the HOST cannot assure that the property will be presented by cleaners exactly as depicted in the photos or devoid of signs of regular usage. It is incumbent upon the GUEST to thoroughly review the comprehensive advertisement and policies pertaining to the property.
24. BOOKING PLATFORM POLICY: In the case that the booking is processed via an platform such as Airbnb, VRBO, etc., all exchanges of funds will be made through the booking platform according to their terms, unless otherwise agreed to by both parties. They are a payment exchange service only, and not the owner or manager of the rental. All other terms and conditions in this contract supersede and take precedent over any booking platform's terms or conditions.
25. GUEST will follow instructions provided in the provided welcome book which includes Info & Instruction / house rules.
26. COMMERCIAL / FILMING / PHOTOGRAPHY: No filming or photography is permitted for the purposes of commercial distribution or profit. This agreement is for recreational purposes only. Photos shared on social media must include a tag or credit of the rental property or owner.

The property may not be used for any meetings or any other sort of commercial use. Please inquire for details on use of the property for such purposes.
27. PINATAS / CONFETTI / GLITTER / TAPE / FIREWORKS POLICY:
No confetti, glitter, pinatas or any other item similar in nature are allowed anywhere on the premises or grounds. No tape or anything else that will mark the walls may be used to hang decorations. No fireworks of any kind, even safe and sane, may be brought or used in or on the premises.
28. FIREPLACE / FIRE PIT POLICY: The fireplace is not to be used for wood burning fires. It is a very complicated firebox with a blower and improper use can create a fire hazard. An electronic fireplace insert is provided for your use with an extension cord for plugging it in. Do not remove the fireplace insert from the fireplace, or the extension cord and the glass doors must remain open during use.
Fire pit (Gas) – GUEST will fully close the valve on the propane tank when not using. Keep the fire pit covered, wait until fully cooled off before replacing the cover. GUEST is responsible to prevent the cover from blowing away.
29.CHILD SAFETY: The Guest acknowledges that the rental property is not childproofed and understands that they are solely responsible for ensuring child safety during their stay. This includes supervising any children present on the premises and taking appropriate precautions. The Guest further acknowledges that any use of child-related items or equipment within the rental property is at their own risk, and they agree to exercise caution accordingly.
The Guest agrees to indemnify, defend, and hold harmless the Host, including its agents, representatives, and affiliates, from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney fees and court costs) arising out of or related to any injuries, accidents, or incidents involving children during the Guest's occupancy.
30. MINIMUM RENTAL AGE for the primary guest is 25 years of age at the time of reservation. This will be verified with a state or government issued photo ID submitted within 24 hours of booking. The party who is on the contract must occupy the subject property for the full duration of the rental lease. No third party bookings will be accepted. Any exceptions to this must be in writing by the HOST. In the case that this contract is executed, and evidence later shows the minimum age requirement was not met, then the reservation will be considered cancelled by the GUEST and the cancellation policy will be in effect.
31. INDEMNIFICATION & HOLD HARMLESS: The GUEST agrees to indemnify, defend and hold the HOST OR RENTAL MANAGER of the property harmless for from any and all claims, demands, liabilities, damage, cost or expense whatsoever (including attorney’s fees) arising from or related to any claim in connection with your use and/or occupancy of the Vacation Rental and it’s amenities, including, but not limited to, any claim or liability for personal injury, property damage, wrongful death, accidents, allergic reactions, illnesses or any other casualties or health problems, including viruses, which may arise during tenancy or as a result of said occupancy, loss of personal belongings or theft of property which is made, incurred or sustained by you and/or anyone you invite to use the Vacation Rental as your guest.
Safety precautions undertaken by HOST are not foolproof, and GUEST shall hold HOST harmless from all claims to person or property arising out of the use and occupancy of the premises.
32. POOL / HOT TUB / HAMMOCK / SWINGS / OUTDOOR THEATER:
The $100 facilities fee for these amenities is included in the rent paid. In the case that any of these amenities are unusable due to mechanical or any other failure the facilities fee is the maximum that will be refunded, amount based on the amenity not in order. If GUEST finds either facility in unsatisfactory condition upon arrival, please refer to #10 in this agreement.
a. The GUEST acknowledges that the property contains a pool and hot tub (hereinafter referred to as "Amenities"). The GUEST agrees to use the Amenities at their own risk and accepts full responsibility for their safety, as well as the safety of any accompanying individuals.
b. The GUEST acknowledges and understands that the use of the Amenities involves inherent risks, including but not limited to drowning, slipping, falling, or sustaining injuries. The GUEST voluntarily assumes all such risks and releases the HOST from all liability arising from the use of the Amenities.
c. The GUEST agrees to abide by all rules and guidelines provided by the HOST regarding the use of the Amenities. The GUEST shall ensure that all individuals using the Amenities under their supervision also comply with these rules and guidelines.
All GUESTS must shower and remove all makeup, hair products, body products prior to entering the water. Chlorine floaters and scum absorbers must remain in the water at all times. If water needs to be changed after GUEST'S stay, a $120 fee will be charged per amenity.
d. The GUEST shall exercise reasonable care and caution while using the Amenities. Children and individuals who are not competent swimmers must be always supervised by a responsible adult when in or around the Amenities.
e. The GUEST agrees to keep the covers to the hot tub and pool closed and secured when not in use, especially when children are present. The covers must be handled with care. The pool cover must be rolled up on the bracket and the hot tub cover must be kept on the frame attached to the hot tub. Covers must never touch the ground.
GUEST will keep the hatch under the deck closed and shall not tamper with or attempt to disable any safety features, equipment, or devices related to the Amenities.
f. The GUEST agrees to refrain from using the Amenities while under the influence of alcohol, drugs, or any substances that may impair their judgment or physical abilities. The GUEST shall ensure that all individuals using the Amenities under their supervision are also in a fit condition to do so safely.
g. The GUEST acknowledges that the HOST has not made any representations or warranties regarding the safety or condition of the Amenities. The GUEST accepts the Amenities in their "as-is" condition and agrees that the HOST shall not be held responsible for any defects, malfunctions, or hazards associated with the Amenities.
h. The GUEST acknowledges that the HOST insurance may not cover any injuries or damages sustained while using the Amenities. The GUEST is encouraged to obtain their own insurance coverage to protect against such risks.
i. HAMMOCK SWINGS: The GUEST acknowledges and agrees that any use of these amenities located on the premises is at their own risk. The GUEST assumes full responsibility for the supervision of any children or minors utilizing the amenities during their stay. The HOST shall not be held liable for any injuries, accidents, or incidents that may occur as a result of the use of the amenities. The GUEST agrees to indemnify and hold harmless the HOST from any claims, damages, or liabilities arising from the use of the amenities by themselves, their guests, or any accompanying children or minors.
33. LEGAL ACTION: By signing this agreement, the GUEST waives the right to pursue legal action in court and agrees to resolve disputes through arbitration or mediation. The GUEST must first seek any award from the online booking platform, with any additional awards limited to the coverage specified in the host's insurance policies.
I agree that all rental monies are subject to the cancellation policy above. I have read my rights to purchase travel insurance. By signing below, I agree to all terms and conditions of this agreement.
Animal Addendum to Vacation Lease (valid only upon disclosure of animals attending prior to stay)
GUEST desires to keep a certain dog/s described below on the Property and the Vacation Lease Agreement specifically prohibits allowing animals on the property.
DEFINITIONS: The term “Pet” is used to describe any animal accompanying the GUEST including service and emotional support animals. The Lease Agreement is hereby amended by this Animal Addendum to grant such permission to the GUEST. In exchange for this permission, the GUEST agrees as follows:
1. To accurately disclose total number of animals GUEST’s party will bring prior to arrival including emotional support or service animals. Max animal occupancy is determined at the top of this agreement. Maximum 2 at any time.
2. To pay additional pet rent in the amount of [$75 ] Dollars per animal. [Legitimate ADA service animal/s excluded]
3. To keep the animal/s from causing any annoyance or discomfort to others and to immediately remedy any complaints concerning the animal/s.
4. To keep the animal/s from damaging any property belonging to the HOST or others.
5. To keep the animal/s off of and/or cover furniture and beds. Floors must be protected from scratches from dog crates. Coverings must be provided by the GUEST. Any animal/s hair found on linens or furniture will result in an extra cleaning fee.
Animal/s are prohibited from going in the plunge pool.
6. To leave no evidence of the pet/s anywhere on the property upon departure.
7. To keep the animal/s under control at all times and abide by [Atascadero] leash laws.
8. Not to leave the pet/s unattended for more than 4 hours. When unattended, animals must be secured inside a pen in the kitchen or game room or crated. Any service or emotional support animal/s left unattended will be considered a pet and the pet fee will be applicable and due.
9. To hold the HOST harmless from all liability, harm or damages, arising from the GUEST's keeping of the animal/s on the premises, including but not limited to any liability resulting from the HOST turning said animal/s over to local pet policing authorities should the animal/s be found unsupervised for more than 6 hours at a time or causing damage or noise disturbance.
10. To dispose of the animal/s droppings quickly in a sealed bag and placed in the outside trash bin. No droppings will be left on the ground or brought into the property. If animal droppings are found there will be a $50 disposal fee.
11. To ensure that animal/s will wear the appropriate animal license, a valid rabies tag and tag bearing the owners name and phone number. All licenses and tags must be current.
12. To provide the HOST with the following information 30 days prior to arrival: that all vaccinations are current, and proof of flea/tick medication or that the animal/s is/are free from fleas, ticks, or other infestations.
13. The GUEST certifies that the animal/s does not display a tendency to be aggressive or harmful and is fully responsible for any such behavior in the case that it occurs on the premises or anywhere during the GUESTS scheduled booking.
14. GUEST agrees to prevent flea infestation and will exterminate if necessary, and upon demand, in all areas affected with full cost to be paid by GUEST.
15. GUEST agrees that HOST will not be responsible for the injury, harm, or death of the animal, and agrees to hold HOST harmless for any injury, damages or losses suffered because of any harm caused on the animal or by the animal upon another person, guest or employee. GUEST shall be responsible for the entire amount of all damages and/or losses caused by the animal/s as well as the entire amount of any injury to individuals or property.
I ACCEPT FINANCIAL RESPONSIBILITY FOR THE ENTIRE AMOUNT OF ANY DAMAGES OR INJURY TO PERSONS OR PROPERTY THAT MAY OCCUR BECAUSE OF MY ANIMAL/S.
